Terms of Service

Effective date: 2026-10-16. Last updated: 2026-10-16.

These Terms of Service ("Terms") are an agreement between you and GCExperts LLC ("we", "us") governing your use of The Handyman Austin at thehandymanaustin.com ("the Service"), a website about hiring a handyman in Austin, Texas. The Handyman Austin is a paid introduction service. By creating an account or using the Service you agree to these Terms.

Who we are. The Service is operated by GCEXPERTS LLC (also written "GCExperts LLC"), a Texas limited liability company. As recorded by the State of Texas, the entity's Secretary of State / Comptroller file number is 0804996600, its Comptroller taxpayer number is 32089185790, and its address of record with the Comptroller is 300 Brushy Creek Rd Ste 404, Cedar Park, TX 78613. GCEXPERTS LLC operates a marketplace and introduction service; it does not perform handyman or construction work, and it is not a handyman or a construction contractor.

1. Nature of the Service — what we are, and what we are not

The Handyman Austin is a technology introduction service only. We operate a website that lets a customer describe a job and lets a handyman pay to see that customer's contact details so the two can talk directly. We are not a contractor, subcontractor, construction manager, employer, joint venturer, partner, or agent of any customer or handyman, and creating an account or an introduction does not create any agency (actual, apparent, or ostensible), joint venture, employment, partnership, or fiduciary relationship between us and you.

We do not direct, control, schedule, supervise, or inspect any work; we do not set, negotiate, or take a cut of the price of any work; and we are not a party to any agreement between a customer and a handyman. All work arrangements, prices, and payments for work are between the customer and the handyman directly. We do not guarantee the quality, safety, legality, price, timeliness, or completion of any work, and to the fullest extent permitted by law we disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, as to the Service and any handyman. How we market the Service, how our support team talks about it, and how the product works all match this section — we do not do, in practice, what this section says we do not do. We operate a marketplace and introduction service and do not perform handyman or construction work.

2. Accounts

You must provide a valid email address and keep your password confidential. You are responsible for activity under your account. You must be at least 18 years old to take part in a paid introduction, and old enough to enter this agreement where you live, to create an account.

3. Free listings, free search, and the paid Introduction

Creating an account, publishing a handyman listing, and searching the directory are free. The only charge is for the Introduction that connects a customer and a handyman, which is $4.99 per introduction (paid by the handyman). The customer is never charged. The price is always shown before any payment is taken, and card details are handled entirely by Stripe. The exact model and price are set by the operator and stated on the Pricing page before any real charge can occur.

4. No verification — you must check for yourself; handyman obligations

4.1 No verification. We do not verify, screen, or check anyone. We do not check licenses, insurance, permits, criminal background, identity, or the truth of any listing, and we do not endorse or recommend any handyman. A handyman is required to attest that they hold any license or insurance the law requires for their trade, but an attestation is not verification — we do not confirm it. Customers must independently verify a handyman's license, insurance, and suitability before hiring, and should do so especially for regulated work such as electrical, plumbing, and HVAC, which Texas licenses. Do not rely on a listing on this site as evidence of any qualification, and do not rely on any rating or review as a guarantee of any result.

4.2 Your obligations if you take work as a handyman. If you take work as a handyman through the Service, you alone are responsible for that work and for your own business, and you agree that you will:

We do not organise, arrange, direct, or take part in door-to-door solicitation, and we do not act as your agent or as the customer's agent. You must not describe yourself as an employee, agent, or representative of GCExperts LLC, and you must not hold yourself out as licensed, insured, bonded, certified, or background-checked by us.

5. Follow-up, disputes, and ratings

After an introduction we may ask the customer to confirm whether the job was completed. Only a customer with a confirmed connection may leave a rating, and a customer may leave at most one rating per job. A rating is published after a short cooling-off window (about 48 hours), and a disputed job freezes the rating. We never write, edit, or rewrite the substance of a review, and we do not suppress reviews because they are negative. Our full rules — including how the aggregate star rating is computed, and when a review is removed — are in the Ratings & Reviews Policy, which forms part of these Terms.

6. The Introduction Fee — what you pay for, and refunds

This section applies to the handyman who pays the Introduction Fee. The customer is never charged.

6.1 What you pay for. You pay a one-time $4.99 Introduction Fee for each unlock, for identifying a customer and delivering that customer's contact information to you. It is a fee for the introduction — not for any work, a hire, or any result or outcome. The customer is never charged.

6.2 When the fee is earned. The Introduction Fee is earned in full, and the service is complete, at the moment the customer's contact information is revealed to you.

6.3 Your authorization. By clicking "Unlock" you authorize GCExperts LLC and Stripe to charge $4.99 to your payment method immediately before the reveal. The amount and its one-time nature are shown to you before you confirm. Card details are handled entirely by Stripe, not by us.

6.4 No subscription; no charge for inaction. We do not operate a subscription or bill on a recurring basis, and we do not charge based on your inaction or a customer's silence.

6.5 No refunds except as stated — please read this carefully

THE INTRODUCTION FEE IS NOT REFUNDABLE ONCE THE CUSTOMER'S CONTACT INFORMATION IS REVEALED TO YOU. The fee pays for the delivered introduction, and that service is complete at the reveal. It is refundable only under the two limited, person-reviewed exceptions in sections 6.6 and 6.7 below. THE CUSTOMER IS NEVER CHARGED, SO NO REFUND EVER APPLIES TO A CUSTOMER.

6.6 No-show exception (after the reveal). If the customer agreed a date and time for the job and then did not appear or did not respond to reasonable attempts to reach them, you may ask us to review the fee. We decide these claims by hand, with a person, never automatically. To ask, email [email protected] within 30 days of the reveal with (a) your transaction id, (b) the agreed date and time, (c) at least two documented attempts made on different days to reach the customer, and (d) a short statement of what happened. We refund to your original payment method only if we approve the claim. A claim is limited to one per handyman per 30 days, and is refused if the job was in fact confirmed done.

6.7 Delivery-failure exception (at the reveal). If the contact information you receive at the reveal is invalid or not in service — for example a disconnected number or a bounced address — that is a delivery failure, which is different from a no-show. Tell us within 7 days of the reveal, and we will reverse the fee and refund it to your original payment method. No two documented attempts are required for a delivery failure, and the one-per-30-days and 30-day limits in section 6.6 do not apply to it.

6.8 How refunds are paid. An approved refund goes back to the original payment method, through Stripe, within a reasonable time of approval.

6.9 Billing disputes. If you believe you were charged in error, contact [email protected] before you ask your bank or card issuer to reverse the charge, so we can look at it with you.

6.10 Non-waivable rights

NOTHING IN THESE TERMS LIMITS ANY RIGHT YOU HAVE THAT CANNOT BE WAIVED OR LIMITED UNDER APPLICABLE LAW, INCLUDING ANY NON-WAIVABLE RIGHT UNDER THE TEXAS DECEPTIVE TRADE PRACTICES ACT (Tex. Bus. & Com. Code ch. 17).

7. Cancellation, suspension, and termination

7.1 You can stop at any time at no cost. A customer can close a posted job for free at any time before a handyman unlocks it, and a handyman can simply choose not to unlock a job — there is no charge for not paying, for not answering, or for cancelling before the reveal. Once the customer's contact information is revealed, the Introduction is complete and the Introduction Fee is earned and non-refundable except under sections 6.6 and 6.7. Cancelling a connection after the reveal does not create a refund. The customer is never charged.

7.2 Closing your account. You may close your account at any time from your account page or by emailing [email protected], and you may ask us to delete your data as described in the Privacy Policy. Closing your account ends your access to the Service; it does not cancel an Introduction Fee that was already earned at a reveal, and it does not remove records we must keep by law.

7.3 Suspension and termination by us. We may suspend or terminate your account or your access to the Service, with or without notice, if you break these Terms or the law, if we are required to by law, if your account is used for fraud or abuse, or to protect other users or the Service. Where it is reasonable to do so, we will tell you and let you put things right first. If we terminate your account for our convenience and you have paid an Introduction Fee that has not yet been earned, we will refund that unearned fee.

7.4 Effect of termination; survival. On termination, your right to use the Service ends. Sections that by their nature should survive termination — including sections 4, 6, 9, 11, 12, 14, 15, 16, 17, and 18 — continue to apply.

8. Acceptable use

You agree not to:

To report a listing, a review, or a user that breaks these rules (for example a fake listing or an abusive review), email [email protected] and we will review it against our records.

9. Intellectual property and notice-and-takedown (DMCA)

The Service, its content, and its branding are owned by us or our licensors and are protected by law. You grant us a license to display the listing content you submit for the purpose of operating the Service.

Designated DMCA agent. Our designated agent to receive notifications of claimed copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512) is: Copyright Agent, GCExperts LLC, 300 Brushy Creek Rd Ste 404, Cedar Park, TX 78613, United States; email [email protected]. Notices sent to that address reach the designated agent.

A valid notice must identify the copyrighted work, identify the material you say is infringing and where it appears, give your contact details, state that you have a good-faith belief the use is unauthorised, state under penalty of perjury that your notice is accurate and that you are the owner or authorised to act for the owner, and include your physical or electronic signature. We will remove or disable access to material that is the subject of a valid notice and may notify the person who posted it.

10. Third-party services

The Service relies on third parties such as Stripe for payments and our email provider for transactional email. Their terms and privacy practices apply to those parts of the Service.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted or error-free, or that any handyman will perform any work. We do not verify anyone, and we do not warrant the identity, qualifications, licensing, insurance, or work of any handyman. Some jurisdictions do not allow the exclusion of certain warranties, so part of the block above may not apply to you; nothing in it excludes a warranty that cannot be excluded by law.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE OR TO ANY WORK PERFORMED OR NOT PERFORMED BY A HANDYMAN, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS.

Nothing in these Terms limits any liability that cannot be limited by law, and nothing limits any right that cannot be waived by law (see section 6.10).

13. Changes and contact

We may update these Terms; the effective date above will change when we do. Questions go to [email protected].

14. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless GCExperts LLC and its officers, members, employees, and agents from and against any claim, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) content you submit, including a listing or a review; (c) your breach of these Terms or the law; (d) if you are a handyman, the work you perform or fail to perform, and your licenses, insurance, permits, taxes, and dealings with a customer; or (e) if you are a customer, your dealings with a handyman. This does not require you to indemnify us for our own negligence or wrongdoing, or for any liability we cannot lawfully pass to you.

15. Notices

We may give you notice by email to the address on your account, by a message in your account, or by posting it on the Service. You agree that these electronic notices satisfy any legal requirement that a notice be in writing. You are responsible for keeping your email address current. Notices to us must be sent to [email protected] or, for copyright notices, to the designated DMCA agent in section 9.

16. Communications consent (email, text, and calls)

16.1 Service messages. We send transactional and service messages that are necessary to run your account and the Service (for example password resets and payment receipts). You cannot opt out of these while you hold an account, and they are not marketing.

16.2 Marketing consent is separate and optional. We will not send you marketing email or marketing text messages unless you separately opt in. Opting in is never a condition of using the Service. Your consent covers calls, texts, and emails made with an automatic telephone dialing system or an artificial or prerecorded voice only where you have expressly agreed. Consent is not a condition of any purchase.

16.3 Opting out. Every marketing message we send includes a way to opt out — reply STOP to a text, or use the unsubscribe link in an email. You can also email [email protected] at any time. We honour opt-out requests promptly, and we will not sell or share your telephone number. Message and data rates may apply; message frequency varies.

16.4 The law we follow. Our calling, texting, and emailing practices are designed to comply with the Telephone Consumer Protection Act (47 U.S.C. § 227 and 47 C.F.R. § 64.1200), Texas's telephone-solicitation law (Tex. Bus. & Com. Code ch. 301), and the CAN-SPAM Act for commercial email. We maintain internal do-not-call and suppression lists and honour the National Do Not Call Registry. If you have a question or want us to stop contacting you, email [email protected].

17. General

Severability. If any part of these Terms is found unenforceable, the rest stays in effect, and the unenforceable part is narrowed to the minimum extent needed to make it enforceable.

Assignment. You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to an affiliate or to a successor in connection with a merger, acquisition, reorganisation, or sale of assets.

Entire agreement. These Terms, together with the Privacy Policy and the Ratings & Reviews Policy, are the entire agreement between you and us about the Service and replace any earlier agreement or understanding.

No waiver. If we do not enforce a provision, that is not a waiver of it, and a waiver on one occasion is not a waiver on another.

Force majeure. We are not liable for a failure or delay caused by something beyond our reasonable control, including a natural disaster, war, terrorism, labour dispute, government action, internet or utility failure, or a third-party service outage.

Survival. The provisions that by their nature should survive termination, including sections 4, 6, 9, 11, 12, 14, 15, 16, 17, and 18, survive termination of these Terms.

18. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Subject to any right you have that cannot be waived by law (including under the Texas Deceptive Trade Practices Act), you and we agree to the exclusive jurisdiction of the state and federal courts located in Williamson County, Texas, for any dispute arising out of or relating to these Terms or the Service.
